a) Election:
The Speaker is
elected by the Assembly at the beginning of the legislature upon secret vote and
absolute majority in the case of many candidates and by a show of hands and upon
the majority of the votes expressed when there is only one candidate.
The term
of mandate of the Speaker is of 5 years.
b) Vacancy:
In case of
vacancy of the presidency of the National People’s Assembly, occurring in the
cases provided for in the rules of procedure, the vacancy of the seat is filled
within the 15 days following the declaration of vacancy made by the National
People’s Assembly.
c) Prerogatives:
The Speaker has
prerogatives vested in him by the Constitution, the organic law which fixes the
organization and the functioning of both the National People’s Assembly and the
Council of Nation, and the rules of procedure.
Constitutional prerogatives:
The Speaker of
the National People’s Assembly is consulted by the President of the Republic on
the following cases:

Dissolution of
the National People’s Assembly or organization of anticipated legislative
elections (art. 84 and 129 of the Constitution),

Establishment
of the state of emergency or exceptional state (art. 91 and 93 of the
Constitution),
|
 |
General
mobilization and declaration of war (art. 94 and 95 of the Constitution),
|
 |
The Speaker of
the National People’s Assembly may besides:

Require the
opening of a debate on the foreign policy,
|
 |
Refer to the
Constitutional Council.

 |
Parliamentary prerogatives:
In conformity
with the Organic Law 99/02 which fixes the organization and the functioning of
both the National People’s Assembly and the Council of Nation, the Speaker of
the National People’s Assembly carries out the following missions:

To
summon the organs and authorities of the Assembly,
|
 |
To chair the
meetings of the Bureau, of the conference of presidents, and that of the
co-ordinating committee,
|
 |
To conduct the
debates and see that the rules of procedure of the National People’s
Assembly are observed,
|
 |
To appoint the
secretary general, and fill the posts of the National People’s Assembly
administrative departments, after consultation with the bureau,
|
 |
To determine
the modes of functioning of the Assembly administrative departments,
|
 |
To see
to the security of the head office,
|
 |
To
represent the National People’s Assembly,
|
 |
To
distribute the tasks among the vice-presidents of the National People’s Assembly,
|
The
Speaker is moreover responsible for the Assembly budget
|
